Limitations of liability
- If a money transfer you ordered is delayed or fails, you may have a right to receive a refund less applicable fees or compensation under Money Transfer Regulations. Please contact us at info@paidx.co.uk for more information regarding refunds and compensations.
- Claims for refund or compensation must be supported by all available evidence.
- If a money transfer in accordance with an order you made and that we Confirmed is delayed or fails and you are not entitled to a refund or compensation under the Money Transfer Regulations, we expressly limit our liability in respect of any such delayed or failed transfer (including for any claimed refund) to the greater of: (a) the amount of any service charge that was paid to us; and (b) €600. The foregoing cap on our liability applies to any single transaction, act, omission or event and to any number of related transactions, acts, and omissions or events.
- We shall not be liable to you or to any third party in relation to the Services, whether for breach of contract, tort (including negligence), misrepresentation, unjust enrichment or any other grounds, for any indirect, incidental, consequential or special damages including any loss of profits or savings or anticipated profits or savings, loss of data, loss of opportunity, loss or reputation, goodwill or business or any economic loss, even if we are advised in advance of the possibility of such loss.
- We are not liable for the quality, safety, legality, or delivery of the goods or services that you pay for using the Services.
- We shall not be liable for any breach of our obligations under the Contract to you nor for any failure or delay in performance of any obligations under the Contract arising from or attributable to acts, events, omissions or accidents beyond our reasonable control, including, without limitation, where our failure to perform our obligations arise from:
- an act of God, fire, flood, earthquake, windstorm or another natural disaster, explosion or accidental damage, war, the threat of or preparation for war, armed conflict, imposition of sanctions, embargo, export controls, breaking off of diplomatic relations or similar actions, terrorist attack, civil war, civil commotion or riots, pandemic or epidemic, industrial disputes, shortages of raw materials or components, general disruptions to transportation, telecommunication systems, power supply or other utilities;
- the acts, decrees, legislation, regulations or restrictions imposed by any government or state;
- the actions or omissions of the third parties;
- malfunctions in communications facilities that cannot reasonably be considered to be under our control and that may affect the accuracy or timeliness of messages you send to us;
- any losses or delays in transmission of messages arising out of the use of any internet access service provider or caused by any browser or other software which is not under our control; or
- any Malicious Code interfering with the Service
- (each, a “Force Majeure Event”).
- Our performance under the Contract shall be deemed suspended for the period that the Force Majeure Event continues and the time for performance will be extended for the duration of that period. We will use our reasonable endeavours to find a solution by which our obligations under the Contract may be resumed despite the Force Majeure Event.
Terms and Conditions of Fee-Free Offer
1. Acceptance of Terms and Conditions: By utilising the services of PAIDX for money remittance, the customer acknowledges and agrees to comply with these terms and conditions.
2. Services Provided: PAIDX offers money remittance services to facilitate the transfer of funds from the sender to the designated recipient via third parties; Ria, Western Union, and Moneygram. The services may include electronic transfers, cash pickups, and other related financial transactions.
3. Eligibility: Customers must meet the eligibility criteria set by PAIDX to use the money remittance services. The company reserves the right to refuse service to anyone at its discretion.
4. Fees and Charges: Customers are responsible for paying the applicable fees associated with the money remittance services. These fees may vary based on the amount of money transferred, the chosen delivery method, and other relevant factors. Fee-free bank transfers are not available in all countries. This offer is only available in eligible countries i.e. Pakistan. Our customer support agent will inform you of any applicable charges or if you can send fee-free money transfers to other countries. Our customer support agent would strive to assist you in saving money or applicable charges where possible to enable you to make informed decisions.
5. Exchange Rates: Exchange rates applied by PAIDX will be disclosed to the customer before the transaction is completed. The rates may fluctuate based on market conditions and may differ from rates offered by other financial institutions.
6. Transaction Limits: PAIDX may impose limits on the amount of money that can be remitted per transaction or within a specified period. Customers are responsible for adhering to these limits.
7. Verification and Compliance: Customers must provide accurate and complete information during the registration and transaction process. PAIDX reserves the right to verify customer identity and compliance with applicable laws and regulations.
8. Cancellation and Refunds: Once a transaction is initiated, it may not be cancelled, and fees are non-refundable. However, PAIDX will make reasonable efforts to rectify any errors or issues that may arise during the remittance process.
9. Privacy and Security: PAIDX prioritizes the privacy and security of customer information. Personal and financial data will be handled in accordance with the company’s privacy policy and relevant data protection laws.
10. Disclaimers: PAIDX is not liable for delays, errors, or disruptions beyond its control, including but not limited to issues with banking systems, government regulations, or force majeure events.
11. Amendments: PAIDX reserves the right to amend these terms and conditions or cancel any offers at any time without notice.
